These Official Rules (“Rules” or “Official Rules”) apply to the GPS Store #5385 (located at 4537 Chamblee Dunwoody Road, Dunwoody, Georgia 30338) (the “Restaurant”) WHOPPER® Sandwiches for a Year Promotion (the “Promotion”) conducted by GPS Hospitality, LLC, 2100 Riveredge Parkway, Suite 850, Atlanta, Georgia, 30328 (“Sponsor”). This Promotion is sponsored and administered solely by Sponsor, an independent franchisee of Burger King Company LLC (“BKC”). Promotion is not sponsored, endorsed or administered by BKC. Any and all questions, comments or complaints regarding the Promotion should be directed to Sponsor and not BKC.
- ELIGIBILITY. The Promotion is open only to legal residents of the United States who reside in the state of Georgia who are at least eighteen (18) years old as of the first day of the Promotion Period (defined below). Employees of Sponsor or BKC, or its or their parent, subsidiaries or affiliate companies, or any of its or their advertising agencies or any other company or individual involved with the design, production, execution or distribution of the Promotion, as well as their immediate family (parent, child, spouse, or sibling and their respective spouses, regardless of where they reside) and those living in the same household, whether or not related, of each such employee are not eligible to win. The Promotion is subject to all applicable federal, state, and local laws and regulations. Participation constitutes each participant’s full and unconditional agreement to these Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules.
- TIMING: The Promotion begins on July 20, 2024 at 11:00 a.m., and ends at 11:59 p.m. (local time at the Restaurant) on July 27, 2024 (the “Promotion Period”).
- HOW TO ENTER: During the Promotion Period, visit the Restaurant during regular business hours and complete an entry form. Registration is free. There is no obligation or fee to register. Limit one (1) entry per person. An entry will not be valid unless all the fields of the entry form are complete and the information is valid. Entry forms will be provided at the Restaurant.
- HOW WINNERS CHOSEN; ODDS: The Restaurant will conduct a random drawing on August 1, 2024 at 3:00 p.m. (local time at the Restaurant) and one (1) Grand Prize will be awarded at the drawing. The potential winner will be selected from among all eligible entries received at the Restaurant. Sponsor’s decision as to the selection of the potential winner will be final and binding. Entrants do not need to be present to win. Odds of winning depend on the number of eligible entries received.
- GRAND PRIZE: The Grand Prize is one (1) year of WHOPPER® sandwiches and will be awarded in the form of a BK® Crown Card in the amount of $350 USD. This Average Retail Value (“ARV”) assumes purchase of a regular WHOPPER® sandwich each week for 52 weeks at a cost of $6.73 USD or less based on average retail value of a WHOPPER® sandwich in the United States. BK® Crown Cards (gift cards) are valid at any Burger King® restaurant location in the United States or Canada, which accepts BK® Crown Cards. See https://www.bk.com/crowncard for terms and conditions applicable to BK® Crown Cards and a complete list of Burger King® restaurants accepting such cards. Prizes cannot be combined with any other offer or sold or redeemed for cash. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize or a component thereof for one of equal or greater value if the designated prize should become unavailable for any reason. The Winner is responsible for all taxes and fees associated with prize receipt and/or use. Sponsor will not replace lost, stolen or damaged BK® Crown Card.
- NOTIFICATION OF POTENTIAL WINNER: The potential winner will be notified by telephone or email within ten (10) business days following the drawing date with instructions on how to claim the prize, and may be required to execute and return an affidavit of eligibility, liability release, and where lawful, a publicity release, within five (5) business days from date of issuance. If a potential winner cannot be contacted within ten (10) business days following the first attempt, or such documents are not returned within the specified time period, prize notification is returned as undeliverable, or a potential winner is not in compliance with these Rules, the prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected in the same manner.
- ENTRY CONDITIONS AND LIABILITY RELEASE: By entering, each participant agrees to: (a) comply with and be bound by these Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Promotion; (b) release and hold harmless the Sponsor, its franchisor BKC, the Restaurant, and each of its and their respective parents, franchisees, subsidiaries, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Promotion, and all of their respective past and present officers, members, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, damages, losses or liability resulting in whole or in part, directly or indirectly, from participant’s participation in the Promotion and/or the acceptance, use or misuse of any prize that may be won, gift card delivery or violation of rights of publicity.
- PUBLICITY. Except where prohibited by law, participation in the Promotion constitutes winner’s consent to Sponsor and its agents’ use of winner’s name, likeness, photograph, voice, opinions, statements made by or attributed to winner and/or hometown and state for promotional purposes in any media now known or hereafter discovered, worldwide, without further notice, review, approval, payment or consideration, including without limitation, the World Wide Web.
- GENERAL CONDITIONS; LIMITATIONS: No more than the stated number of prizes will be awarded. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. The Released Parties are not responsible for: (a) any incorrect or inaccurate information, printing, human or inadvertent errors, or technical failures of any kind; (b) unauthorized human intervention in any part of the Promotion; (c) technical or human error which may occur in the administration of the Promotion, or fulfillment of prizes; or (d) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize.
- DISPUTES: All issues and question concerning the construction, validity, interpretation, and enforceability of these Rules or the rights and obligations of participants and Sponsor in connection with the Promotion shall be governed by and construed in accordance with the law of the State of Georgia without giving effect to any choice of law or conflict of laws rules or provisions. Except where prohibited, participants agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state courts located in Fulton County, Georgia (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will a participant be permitted to obtain awards for, and each participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased, other than for actual out-of-pocket expenses. All descriptive headings of sections and paragraphs are intended solely for convenience, and no provision of these Official Rules is to be construed by reference to the heading of any section or paragraph. These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event any provision is determined to be invalid or otherwise unenforceable, or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
- OTHER TERMS: Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect. In the event this Promotion is challenged by any legal or regulatory authority (including but not limited to any federal or state governmental authority), Sponsor reserves the right to discontinue or modify the Promotion, as applicable, or to disqualify any participants residing in any affected geographic areas, as applicable. In such event, Sponsor shall have no liability to any participants who are disqualified due to such an action.
- OFFICIAL RULES AND GRAND PRIZE WINNERS: Any inquiries or questions regarding this Promotion, including any request to receive the name of the winner (available 15 days after end of drawing date), or a copy of the Official Rules may be requested by mail with a clear return physical mail address to reply to Sponsor at: GPS Store #5385 (located at 4537 Chamblee Dunwoody Road, Dunwoody, Georgia 30338) (the “Restaurant”) WHOPPER® Sandwiches for a Year, Attn: GPS Hospitality Promotions, 2100 Riveredge Parkway, Suite 850, Atlanta, Georgia 30328. Requests must be received no later than ninety (90) days following the end of the Promotion Period.
